This is a good cover of First Amendment or Fourth Amendment rights. But also a lesson learned for tenant rights and premise liability. I think it is a good time for Arcadia City Hall to take a step back, after the Blessed MLK Day, to think about case precedent and determine the extent of property rights and premise liability extended to all homeowners, and lessors who create a business in their homestead. But for now, it seems to still be an interest that is rationally tailored to a legitimate interest. And it will be interesting to see how this case develops.
